By accessing and using eFeis.com ("the Site"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. These Terms include and incorporate by reference our Privacy Policy, Refund Policy, and Cookie Policy. If you do not agree with any part of these terms or the incorporated policies, you must not use our services.

User Age and Eligibility: By using the Site, you affirm that you are at least 18 years of age, or that you are a parent or legal guardian of a user under 18 and you agree to these Terms on their behalf.

eFeis LLC provides the platform to facilitate these activities but is not a party to the direct agreement between an event organizer and a participant. We are not responsible for the execution, rules, safety, or outcome of any competition listed on the Site.

You are responsible for creating and maintaining your account. You agree to provide accurate information and to keep your password confidential. You are responsible for all activities that occur under your account.

All content on eFeis.com, including text, graphics, logos, and software, is the property of eFeis LLC or its content suppliers and is protected by copyright laws. Users may not copy, modify, or distribute site content without our prior written permission.

User-Generated Content: If you post or upload content to the Site ("User Content"), you grant eFeis LLC a non-exclusive, royalty-free, worldwide license to use, host, and display such User Content solely for the purpose of operating and providing the services of the Site.

6. Payments and Refunds

All fees for competition registrations and related services are processed through our third-party payment processor, Stripe. By providing payment information, you agree to their terms of service. All purchases made on the Site are subject to the eFeis LLC Refund Policy, which you agree to upon making a purchase. As stated in our Refund Policy, all sales are final and non-refundable.

7. Privacy and Data

Your privacy is critically important to us. Our collection and use of personal information in connection with the Site and its services is described in detail in our Privacy Policy. By using our services, you agree that we can use such data in accordance with our Privacy Policy.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that eFeis LLC shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party content or services.

THE SITE AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, eFeis LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

eFeis LLC DOES NOT WARRANT THAT (A) THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (C) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

10. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL eFeis LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (III) ANY CONTENT OBTAINED FROM THE SITE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF eFeis LLC FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID eFeis LLC, IF ANY, IN THE LAST SIX (6) MONTHS.

11. Indemnification

You agree to defend, indemnify, and hold harmless eFeis LLC and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Site, including, but not limited to, your User Content, any use of the Site's content and services other than as expressly authorized in these Terms, or your violation of any law or the rights of a third party.

12. Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms of Service.

If you wish to terminate your account, you may simply discontinue using the Site. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms of Service and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the Commonwealth of Virginia without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Virginia, in each case located in the City of Hampton. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
